Policies and Regulations
Preamble
Article 1 – Object and Scope of Application of the Regulations These regulations apply to all learners (apprenants), i.e., persons participating in a training action organized by ÉSTIAM/Paris.Education, whether they are students or vocational training trainees. These regulations are available at the reception of the establishment as well as on the ÉSTIAM/Paris.Education website (https://paris.education). These regulations define the health and safety rules, the general and permanent rules relating to discipline, as well as the nature and scale of sanctions that may be taken against persons who contravene them and the procedural guarantees applicable when a sanction is envisaged. It also determines the rules for the representation of learners for training courses lasting more than 500 hours. Every person must respect the terms of these regulations throughout the duration of the training action. These regulations are finally supplemented by the ÉSTIAM/Paris.Education academic regulations (règlement des études) which defines all rules related to pedagogy as well as the acquisition and validation of skills.
Section 1: Health and Safety Rules
Article 2 – General Principles The prevention of accident and disease risks is imperative and requires respect from everyone for:

the applicable prescriptions regarding health and safety on the training premises;

any instruction imposed either by the management of ÉSTIAM/Paris.Education or by the manufacturer or the trainer, particularly regarding the use of equipment made available.
Each learner must thus ensure their personal safety and that of others by respecting, depending on their training, the general and specific instructions regarding health and safety. If they notice a malfunction of the safety system, they must immediately warn the management of ÉSTIAM/Paris.Education. Failure to comply with these instructions exposes the person to disciplinary sanctions.
Article 3 – Instructions in Case of Fire Instructions in case of fire and notably a location plan of fire extinguishers and emergency exits are posted in the ÉSTIAM/Paris.Education premises at the reception as well as in each of the training rooms. The learner must take note of them. In case of an alert, the learner must cease all training activity and calmly follow the instructions of the authorized representative of ÉSTIAM/Paris.Education or the emergency services. Any learner witnessing the start of a fire must immediately call emergency services by dialing 18 from a landline or 112 from a mobile phone and alert a representative of ÉSTIAM/Paris.Education.
Article 4 – Alcoholic Beverages and Drugs The introduction or consumption of drugs or alcoholic beverages on the premises is formally prohibited. It is prohibited for learners to enter or remain in a state of drunkenness or under the influence of drugs on the premises of ÉSTIAM/Paris.Education. Learners will have access during breaks to non-alcoholic beverage distribution stations.
Article 5 – Ban on Smoking It is formally prohibited to smoke in the training rooms and more generally within the ÉSTIAM/Paris.Education grounds. Electronic cigarette devices are also concerned by this provision.
Article 6 – Accident The learner victim of an accident – occurring during training or during travel time between the training location and their home or workplace – or the witness to this accident must immediately warn the management of ÉSTIAM/Paris.Education. The person in charge at ÉSTIAM/Paris.Education undertakes the appropriate steps regarding care and carries out the declaration to the competent Social Security fund.
Section 2: General Discipline
Article 7 – Attendance of the Learner in Training
Article 7.1 – Training Hours Learners must comply with the schedules fixed and communicated beforehand by ÉSTIAM/Paris.Education. Non-compliance with these schedules may entail sanctions. Except in exceptional circumstances, learners may not be absent during training hours.
Article 7.2 – Absences, Lateness, or Early Departures In case of absence, lateness, or departure before the scheduled time, learners must warn ÉSTIAM/Paris.Education and provide justification. ÉSTIAM/Paris.Education immediately informs the funder (employer, administration, Fongecif, Region, Pôle-emploi, OPCO,…) of this event. Any event not justified by particular circumstances constitutes a fault liable to disciplinary sanctions. Moreover, in accordance with Article R6341-45 of the Labor Code, the learner – whose remuneration is covered by public authorities – exposes themselves to a deduction from their internship remuneration proportional to the duration of the absence.
Article 7.3 – Formalism Attached to Training Monitoring The learner is required to fill out the sign-in sheet (feuille d’émargement) per half-day of presence as the action unfolds. They may also be asked to carry out an assessment of the training. At the end of the training action, they are given a training completion certificate and a certificate of attendance at the training to be transmitted, as the case may be, to their employer, their administration, and/or the organization financing the training action. The learner submits, as soon as possible, to ÉSTIAM/Paris.Education the documents they must fill out as a service provider (request for remuneration or coverage of costs linked to training; certificates of enrollment or entry into internship…).
Article 8 – Access to Training Premises Unless expressly authorized by the management of ÉSTIAM/Paris.Education, the learner may not:

enter or remain in the training premises for purposes other than training;

introduce, have introduced, or facilitate the introduction of persons foreign to the organization therein;

proceed, in the latter, with the sale of goods or services.
Article 9 – Dress Code The learner is invited to present themselves at ÉSTIAM/Paris.Education in appropriate attire. ÉSTIAM/Paris.Education reserves the right to deny access to the establishment to any person whose attire would be considered inappropriate or contrary to the rules of propriety.
Article 10 – Behavior It is asked of every learner to have a behavior guaranteeing respect for the elementary rules of good manners, of living in a community, and the smooth running of training courses.
Article 11 – Use of Equipment Unless specific authorization from the management of the training organization, the use of training equipment is done on the training premises and is exclusively reserved for the training activity. The use of equipment for personal purposes is prohibited. The learner is required to keep the equipment entrusted to them for the training in good condition. They must make use of it in conformity with its object and according to the rules delivered by the trainer. The learner immediately reports to the trainer any anomaly of the equipment.
Section 3: Disciplinary Measures
Article 12 – Disciplinary Sanctions Any breach by the learner of any of the prescriptions of these internal regulations may be the subject of a sanction pronounced by the person in charge of ÉSTIAM/Paris.Education or their representative. Any act considered as wrongful may, depending on its nature and gravity, be the subject of one or other of the following sanctions:

Call to order (Rappel à l’ordre);

Written warning by the director of ÉSTIAM/Paris.Education or by their representative;

Reprimand (Blâme);
-
Temporary exclusion from the training;
-
Definitive exclusion from the training.
Fines or other pecuniary sanctions are prohibited. The person in charge of ÉSTIAM/Paris.Education or their representative informs of the sanction taken:

The employer of the learner employee or the administration of the learner agent (Editor’s note: only when the training is carried out on order of the employer or the administration);

and/or the funder of the internship.
Article 13 – Disciplinary Guarantees
Article 13.1 – Information of the Learner No sanction may be inflicted on the learner without the latter having been informed beforehand of the grievances held against them. However, when an act considered as wrongful has made a precautionary measure of temporary exclusion with immediate effect indispensable, no definitive sanction relating to this act may be taken without the learner having been informed beforehand of the grievances held against them and possibly, without the procedure described hereafter having been respected.
Article 13.2 – Summons for an Interview When the director of ÉSTIAM/Paris.Education or their representative envisages taking a sanction, the procedure is as follows:

They summon the learner – by email or hand delivery to the interested party against receipt – indicating the object of the summons;

The summons also indicates the date, time, and place of the interview as well as the possibility of being assisted by a person of their choice, learner or employee of ÉSTIAM/Paris.Education.
Article 13.3 – Possible Assistance During the Interview During the interview, the learner may be assisted by a person of their choice, notably the internship delegate. The director of ÉSTIAM/Paris.Education or their representative indicates the reason for the envisaged sanction and gathers the learner’s explanations.
Article 13.4 – Pronouncement of the Sanction The sanction cannot intervene less than one full day nor more than fifteen working days after the interview. The sanction is the subject of a written and motivated notification to the trainee in the form of an email or a hand delivery against receipt.
Section 4: Representation of Learners
Article 14 – Organization of Elections In training courses lasting more than 500 hours, the election of a titular delegate and a substitute delegate proceeds simultaneously by two-round single-member ballot, according to the following modalities:

All learners are voters and eligible. The ballot takes place, during training hours, at the earliest 20 hours and at the latest 40 hours after the start of the internship;

The person in charge of ÉSTIAM/Paris.Education is responsible for the organization of the ballot. They ensure its smooth running.
Article 15 – Duration of the Mandate of Learners’ Delegates Delegates are elected for the duration of the internship. Their functions end when they cease, for any cause whatsoever, to participate in the internship. If the titular delegate and the substitute delegate have ceased their functions before the end of the internship, a new election is proceeded with.
Article 16 – Role of Learners’ Delegates Delegates make any suggestion to improve the running of internships and the living conditions of learners at ÉSTIAM/Paris.Education. They present all individual or collective complaints relating to these matters, to health and safety conditions, and to the application of the internal regulations.
Section 5: Improvement Council (Conseil de perfectionnement)
Article 17 – Definition and Role The Strategic Orientation Committee of ÉSTIAM/Paris.Education constitutes its improvement council. It examines and debates questions relating to the organization and operation of the CFA ÉSTIAM/Paris.Education, notably on:

The pedagogical project;

The general conditions of reception, support of apprentices, notably apprentices with disabilities, promotion of diversity and national and international mobility;

The organization and running of training courses;
-
The general conditions of preparation and pedagogical improvement of trainers;
-
The organization of relations between companies hosting apprentices and the center;
-
Projects for agreements to create a training unit by apprenticeship or agreements with educational establishments, training organizations, or companies allowing the latter to provide teaching normally dispensed by the CFA;
-
Investment projects;
-
Information published each year relating notably to the diploma achievement rate or the apprenticeship contract breach rate (Art. R6231-3 and R6231-4 of the Labor Code).
Article 18 – Operation The presidency of the improvement council is ensured by the president or the director of the training organization or their representative. The internal regulations of the CFA define the operating modalities of the improvement council and the designation of its members (Art. R6231-5 of the Labor Code). New members are designated on the proposal of one or several members of the Improvement Council, after prior agreement of the presidency of the improvement council.
